WARRANTY, RETURNS AND EXCHANGE TERMS Endoskops.lv Online Store
These Warranty and Return Terms (the “Terms”) govern the sale of goods by SIA Armikus (the “Seller”) through the online store Endoskops.lv.
1. Warranty Certificate
1.1. The warranty certificate shall be the electronically issued invoice containing the payment details of the Product.
1.2. The invoice shall indicate the date of receipt of the Product, from which the warranty period shall commence.
1.3. The applicable warranty period may be indicated in the invoice and/or in the Product description prior to purchase.
1.4. The warranty shall be valid only where the invoice correctly specifies the Product name, product code and date of sale.
1.5. Warranty repairs shall be carried out free of charge during the applicable warranty period, subject to compliance with these Terms.
2. Statutory Right of Withdrawal (Distance Contracts)
2.1. In accordance with the Consumer Rights Protection Law of the Republic of Latvia and Cabinet Regulation No. 207 “Regulations Regarding Distance Contracts”, a consumer (natural person acting outside their trade or profession) shall have the right to withdraw from a distance contract within 14 calendar days.
2.2. The withdrawal period shall expire 14 calendar days from the date on which the consumer acquires physical possession of the Product.

2.4. The consumer shall be responsible for any diminished value of the Product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product.
2.5. The Seller reserves the right to withhold an appropriate amount from the refund where the Product is damaged, incomplete or has lost its original condition.
2.6. Returns shall be made via Omniva parcel terminal Rīgas Dammes tirgus (9533), unless otherwise agreed.
3. Procedure and Refunds
3.1. Upon valid withdrawal, the Seller shall reimburse all payments received from the consumer, excluding delivery costs, without undue delay and in any event not later than 14 calendar days from receipt of the withdrawal notice.
3.2. The Seller may withhold reimbursement until the Product has been received back or until the consumer has supplied evidence of having sent back the Product, whichever is earlier.
3.3. The cost of returning the Product shall be borne by the consumer unless otherwise required by law.
4. Condition and Completeness of Returned Products
4.1. The Product must be returned with all components, accessories and included items supplied at purchase.
4.2. The consumer may inspect the Product only to the extent necessary to determine its nature, characteristics and functioning, as would be permitted in a retail environment.
4.3. Where the Product shows signs of use exceeding such inspection, or where components, packaging elements or protective materials are missing, the Seller shall be entitled to reduce the refund proportionally to the decrease in the Product’s market value.
4.4. Any reduction shall be based on an objective assessment of the Product’s condition.
5. Packaging
5.1. The consumer is advised to retain the original packaging for safe return transportation.
5.2. Absence of original packaging alone shall not invalidate the right of withdrawal.
5.3. However, damage to packaging or deterioration affecting the Product’s resale value may result in a proportional reduction of the refund.
6. Specific Conditions Relating to Product Use
6.1. The Product must be used strictly in accordance with its technical specifications and user instructions.
6.2. Use of a camera head in temperatures below -10°C or above +85°C resulting in sensor damage or image defects shall not constitute a manufacturing defect and shall void warranty coverage. In the case of withdrawal, such use may result in a proportional reduction of the refund.
6.3. Use of a charger exceeding the permitted specifications of 5V and 1.5A, resulting in damage (including for models with built-in batteries), shall not constitute a manufacturing defect and shall void warranty coverage.
6.4. If the Product shows clear signs of use and cannot be resold as new, the Seller may reduce the refund to reflect the residual market value of the Product.
6.5. If the Product has completely lost resale value, the refund may be reduced to EUR 0.
6.6. The Seller reserves the right to conduct technical diagnostics, inspection or expert assessment to determine the nature and extent of damage.
6.7. Costs reasonably incurred for diagnostics or assessment may be taken into account when determining the reduction in refund.
7. Statutory Exceptions to the Right of Withdrawal
The right of withdrawal shall not apply:
7.1. After expiry of the statutory withdrawal period.
7.2. Where the price of the Product is dependent upon fluctuations in the financial market which cannot be controlled by the Seller.
7.3. In any other cases provided by applicable law.
7.4. To legal entities.
7.5. Where the Product was physically inspected prior to purchase and the contract was not concluded as a distance contract.
8. Storage of Paid Products (Collection)
8.1. Where “self-collection” is selected, the Product shall be stored free of charge for 30 calendar days from notification of readiness for collection.
8.2. If the Product is not collected within this period, the Seller shall notify the buyer and provide an additional collection period of not less than 14 calendar days.
8.3. Following expiry of the initial storage period, the Seller may charge reasonable storage fees reflecting actual costs incurred.
8.4. If the Product remains uncollected after the additional period, the Seller may:

terminate the contract unilaterally;

refund the amount paid, less documented storage and administrative expenses.
8.5. Title to the Product shall not automatically transfer to the Seller. The Seller may take further action in accordance with applicable law.
9. Failure to Accept Delivery
9.1. If the buyer fails to accept delivery within the timeframe set by the carrier and the Product is returned to the Seller, the Seller shall notify the buyer.
9.2. The returned Product shall be stored free of charge for 20 calendar days.
9.3. After this period, reasonable storage charges may apply.
9.4. If the Product is not collected within the additional period, the Seller may:

terminate the contract;

refund the amount paid, less actual expenses including delivery, return shipping and storage costs.
10. Information and Consultations
10.1. The online store operates as a self-service platform. The buyer independently selects and orders Products based on information published on the website.
10.2. Product descriptions, specifications and usage conditions are provided to enable an informed purchasing decision.
10.3. The Seller provides mandatory pre-contractual information in accordance with applicable law.
10.4. Oral consultations do not form part of the contract unless expressly agreed in writing.
10.5. Consultations are provided for informational purposes only and do not replace the buyer’s obligation to review the Product documentation.
10.6. The Seller shall not be liable for an incorrect choice of Product where the buyer has failed to review the published information or has used the Product contrary to its technical specifications.
